Summary:This research aims to portray the implementation of regulatory enforcement on criminal acts committed by civil servants and the obstacles that impede its enforcement. In parallel, this research aims to provide solutions to the problems of law enforcement on criminal offense committed by a civil servant in the Special Capital Province of Jakarta as part of good governance implementation. This research is a normative legal research, using secondary data that obtained through a literature study subsequently supplemented by interviews with sources informant. As for data analysis, carried out qualitatively and presented descriptively. The result of the research reveals that the enforcement of law on criminal acts committed by civil servants in the Special Capital Province of Jakarta has not functioned as expected. Several emerging problems are caused by the provision of law itself. In particular, Government Regulations (Peraturan Pemerintah) that are not clearly and specifically set the action to be taken against crime carried out by civil servants as a mean to avoid different interpretations. In addition, there is no regulation governing the effort to acquire arrest warrant and court decision which have permanent legal status, whereas both arrest warrant and court decision are the basis for an action to be taken against crime carried out by civil servants. Other obstacle that impedes regulatory enforcement on criminal acts committed by civil servants is the lack of good will from the Government of Jakarta Special Capital Province to enforce the law. This is indicated by the number of criminal cases committed by civil servants in the Special Capital Province of Jakarta but their administrative settlements are incomplete. Based on the above mentioned condition, it is very crucial to alter current civil service regulations, particularly the articles that govern criminal acts committed by civil servants. Furthermore, the Special Capital Province of Jakarta must set law enforcement on civil servants as one of the central agendas within the on going bureaucratic reform process. So that it could create a legal certainty and an equality on taking decision to make a good Governance in the Special Province of Jakarta.
