| description | This research has purpose to identify implementation of agreement on development of plasma palm plantation of PT AMP Plantation in West Pasaman regency and to study obstacles faced in implementation of the agreement. This research used juridical empirical approach, by considering existing legal norm and relating with facts in field to get primary data. It used semi-structured interview guide. Data obtained in field is processed using qualitative analysis and correlated with secondary data. Result of the research was presented in descriptive analytical manner. Results indicated that implementation of agreement on plasma development between PT. AMP Plantation as the first party and KUD Damai Sejahtera as the second party has not run according to agreement, because there is unbalance in right and obligation of each party. The condition make plasma farmer or member of KUD involved in the agreement is disadvantaged. Obstacles faced in the agreement is unclear conversion between PT. AMP Plantation and member of KUD, so palm plantation area is uncared due to less management and no compensation and promise to establish plasma area for member of KUD Damai Sejahtera and colution between administrator of KUD Damai Sejahtera and PT. AMP Plantation as nucleus party so there is no openness fro farmer and member of cooperation. |
