merchandise transaction on commodity trading, right transfer of merchandise in
commodity futures trading and also the protection for the parties involved in this
matter.
This research uses normative method with regulation and conceptual
approach. Data and information on this research are obtained from literature studies
and written interviews. All data which were obtained from literature studies are
collected and then analyzed systematically, analysis towards research data were done
by perspective analysis with deductive method.
The law correlation between related parties in merchandise trading is set on
regulation No.32 year 1997 subsection 18 letter h and in trading regulation 3rd book
chapter V subsection 1457 KUHPerdata. Right transfer of merchandise in commodity
futures trading is based on PBK regulation, contract futures specification contains
date of commodity goods transfer and also the right transfer of merchandise. It occurs
when the delivery date on the contract futures achieved (that is, if commodity goods
are physically being handed over) because settlement in PBK can also be done by
cash settlement, due to the condition when there is no goods that physically being
handed over. Protection for parties who are involved in this matter is set on PBK
regulation subsection 18 letter g, it established settlement mechanism of complaints
and conflicts due to contract futures transaction through forum of discussion to
achieve agreement and ariterase settlement mechanism which is provided by the
futures exchange. |
