Description
Summary:This research aims to identify two issues, first is to identify the implementation of right transfer/ wealth land transaction of under-custody children due to the death of one of their parents at Bekasi Municipality and Regency, and second is to identify the function of Court Decision in property right transfer/ wealth transaction of under-custody children due to the death of one of their parents. The research belongs to juridical-empirical research which focuses on field research. Normative research was also conducted to support and complete primary data by doing library research to obtain secondary data. All the collected data were analyzed qualitatively and presented descriptively. Based on the research result, the right transfer/ wealth land transaction of undercustody children due to the death of one of their parents is conducted by appointing guardian to represent the parents in conducting legal act to transfer the right to land that becomes their rights. The Court decision serves as a permission of transfer of under-aged childrens right to land and functions as protection for children rights towards the transferred wealth. A permission of property right on land owned by under-custody children, the Court Decision serves as the power of attorney given by the state to do legal act of right transfer, in order to that one of alive parents or guardian of under-custody children appointed by the Court still considers the interests and rights of the children in transferring the childrens property right of wealth.
