This was juridical empirical, which means that research conducted in the field related
to the legal rules that are equipped with library research. Field research was conducted with
interviews with sources, Human Resource Development BMT Bina Ummah Godean as a
party which is considered representative in providing the necessary information and data
related to the topics covered. Samples from this study is the customer BMT Bina Ummah
Godean. Data were analyzed qualitatively using descriptive methods.
The results showed that overall Ijarah contract can not be equated with Rent-Renting
Article 1548 Civil Code because the object of extensive Ijarah includes rent and wage-rent.
While from the perspective of Fiqh (Mazhab Syafi�i), Ijarah contract in BMT Bina Ummah
Godean is in compliance with legal requirements in harmony and Ijarah contracts.
In terms of settlement of disputes, the parties in ijarah contract at BMT Bina Ummah Godean
refer to deliberation and consensus, but if they do not find the word consensus so the parties
agree to solve disputes by arbitration through BASYARNAS. |
