| description | This research is intended to find out how the implementation tradition
inheritance system in Dayak Agabag ethnic group society life in Lumbis District,
Nunukan Regency, East Kalimantan Province. This research, uses empirical
juridical or sociological juridical. The technique used and collecting sample is non
probability sampling method, who is the respondent include custom society, the
leader of custom and custom observer. The way used in collecting the data is
purposive sampling, means choose the custom society who have direct involved in
inheritance process. The primary data are received by using interview technique
while secondary data through literary research and the whole data analyzed
qualitatively.
The result of this research shows that the system of tradition inheritance of Dayak
Agabag ethnic in Lumbis District, Nunukan Regency, East Kalimantan Province, is
heritance according to father line and mother line while distribution individually
to each heirs with the same right and part. By applying fine tradition as a symbol of
confession, so that illegitimate child can be inherited his genus father without any
marriage. Widows or widowers are not the heirs of their husband/wife.
Until now did not found yet any inheriting legal action which are solved in
the General Court also did not any jurisdiction/legal administration about
inheriting custom of Dayak Agabag. In accordance, if a problem happened related
to inheriting so that solved by nuclear family discussion included the bigger
family. Supposing that the discussion to reach an agreement is not deadlock, so the
next effort through custom institution. |
