| Summary: | Recognition on traditional fishing rights is one of the factors that affect the demarcation
of the territorial waters of the sea between countries. This study aims to understand the practice
of states in terms of recognition of traditional fishing rights in the demarcation of sea territory.
While other purpose is to investigate the implementation of recognition on traditional fishing
rights in the Determination of marine boundaries between Indonesia and the Philippines.
The method used in this research is normative legal research or literature. Overall the data
obtained were analyzed using a qualitative approach to seeking truth qualitative, namely truth in
the sense of conformity with the size of that set certain quality requirements that must be
fulfilled. To obtain these truths are used qualitative analysis-synthesis model. Based on how the
description of analysis-synthesis then be concluded as an answer to the problems studied.
The results can be concluded that the practice of states related to the recognition of
traditional fishing rights have been done through three ways. First, state practice as the basis and
