Summary: | In discussing about the protection of worker�s right outsourcing job system, have
it been reflect about the protection of Law for worker?
Base on the Laws Number.13 /2003 about The Labor Principally is the Laws that
give the protection to the worker not to the worker in this related in the consideration in letter a to c the Laws number 13 / 2003.
The purpose of this research is in order to known the protection of worker�s right
according to The Laws number 13/2003 about labor, in the job cooperation agreement for the decided time according to article 64-66 The Laws number 13 /2003 d be known with the wholesale of project or namely the company that give a part of project�s implementation to other company through outsourcing agreement or supplying worker/labor service that be written in the writing form in their other part. for the worker because feel of suffer and the uncertainty and also guarantee in the future of job and his/her family because outsourcing in the fact not create the new job opportunity but also that happened is job rotation because of that the descriptive research method, exploration method and explanation method and the research that implemented in this thesis classified normative Law research category that consist of library research and field research because of the result of research the worker of outsourcing can not protect the right. Beside that the worker can not get the protection, such as: (1) Job Security, the limitation of age that be received from 18 � 24 years old by status of contract that the limitation of job between 1-3 years (2) Social Security its right is different absolutely with permanent worker, there is no guarantee of healthy, the pregnant woman can not leave but be cut off her job contract. (3) Income Security: The wage during doing a job only get the minimal wage can not get a insurant of attendance, lunch fee and subsidy of
grand day, Because there is no guarantee of the protection of worker right in the
implementation of outsourcing job, in this matter clear about its contrary to the article 27 point (2) Constitution 1945 Amendment 4th. The policy of outsourcing have been disturb the harmony of job for the worker/labor who in the decided time can be threat the stopping of job.
