| Summary: | An analisis of Peddler Service Giving to Account Executive in Lembaga
Penyiaran Publik in Central Televisi Republik Indonesia in Jakarta. This research
was almed to(1)examine the legal status of the implementation of Peddler service
giving to Account Executive in LPP TVRI, related to the regulation about Nation
Finance about National Treasury and Regulation of civil servant and their
responsibility related to the status of employee in LPP TVRI.(2)find out the law
establishment for the consequence and their resonsibility related to the giving of
peddler service.
This reasearch was a normative juridical research. The data was observed,
studied and analysed based on the library research. The data used was secaondary
data supported by primary data. The secondary data was obtained through library
research comprising of primary, secondary, and tertiary law materials. The primary
data was obtained through field research, either in the form of the result of interview
with source person and responden. The data collected was analyzed qualitatively and
arranged in a descreptive report.
The result of the research showed that the law status of giving peddler service
of 2 to 5 percent of the contract with partners to account executive in LPP TVRI
based on Suarat Keputusan Dewan Direksi No. 220/KPTS/DIREKSI/TVRI/2010 was
in fact there is no basic of law related to regulation No. 17 year 2003 of Regulation
of No. 1 year 2004 and Regulation No. 43 year 1999. Although there was a fit in the
mecanism of peddler service giving with article 34 Government Regulation No. 13
year 2005, and the validity of peddler commission giving is not appropriate with the
target in order to optimize all operating cost of LPP TVRI.
The judicial implication as a result ao authority abuse by publishing Surat
Keputusan Dewan Direksi No. 220.KPTS/DIREKSI/TVRI/2010. Is the responsibility
of the officials making the decision letter. The can punished with administrative
sanction, discipliner sanction discipliner sanction for authority abuse, and tipikor
(making rich of certain group).
