| description | This research discusses about the process of implementing inheritance with
spoken testament in peoples of Malay Indigenous Coastal. This research aims is to
examine and to know about the basics and the process undertaken by indigenous
Malay Coast to sharing inheritance that left by the heir just by spoken and also to
know about the factor that cause some disputes related to spoken inheritance in
peoples of Malay Indigenous Coastal. And this research also aims to analyze
about the stages in the process of resolving disputes that related to spoken
inheritance happen.
This research used Juridical Empirical Methods for collects data, which
means research approach based on legal datas and facts obtained directly from
research areas. For data formulation, this research used Field Research. Field
research that used is Interview method, to collecting the primary data for research
reports. For get a more completely description, author also used Library Research
as secondary data in the research reports. Because the population of this research
is sufficiently large, the sampling technique that author used is Probability
Sampling, take the sample directly or spontaneously to every member of
the sample (Accidental Sampling). Analysis of data that author used in this
research is a qualitative analysis methods by compiling the data in a systematic
and discusses these data qualitatively to make a conclusions from the research that
has been done.
Inheritance process in Malay Indigenous Coastal peoples made by spoken
testaments and be witnessed by other family members and witnesses. This
inheritances potentially creates some disputes in the future. In Inheritance�s
process, the heir wasn�t bounded by customs regulations to determine distribution
of his or her legacy. Generally, the heir determining legacy based on emotional
connection and needs of legatee. Resolving the disputes that relating with
inheritance by spoken in Malay Indigenous Coastal peoples is usually with 2
(two) stages, family discussion that attended by all of family members and
customary deliberation that leads by indigenous leaders and or religious leaders. |
