| description | This study aims to determine how to obtain ownership rigth of land
associated with residential move that made by the Tobo People (Anak Dalam
Tribe) in the village of Sungai Paku Subdistrict of Muara Limun Regency of
Sarolangun in Jambi Province and the optional inheritance law that used and its
implementation in the field due to changes of lifestyle of a wandering life in the
forest toward sedentary and semi-settled lifestyle.
The type of this research is juridical empiric, the study of unwritten of
positive law correlative with the behavior of the meber of society in relationship
of community life. The empiric legal research is intended to uncover the law that
was lived in the society through the act that commited by the society. The study is
focused on the field research by using primary data as the main data and the
secondary data as the supporting data for the research.
The result showed that the differences in the origin of clan of Tobo People
cause difference in land inheritance system. But the strong influence of
acculturation and the entry from the church as a system builder make them divide
the treasure equally for son and daughter on an individual basis. The sedentary life
causes them to have land that can be inherited and be inherited to whole children.
In term of land inheritance, the state treats them as the same protection of property
right as other citizens are limited to physical evidence and administrative that
owned by Tobo people. |
