| Summary: | The purpose of this study was to determine implementation code of ethics of
notaries public notary office in the city of Padang, knowing the enforcement of codes of
ethics by the Board of Honorary notary in the city of Padang, knowing penalties against
notaries who violate the code of conduct notary in the city of Padang
The approach used in this study are Juridical Empirical research is conducted with
due regard to the problems of legal norms and regulations as well as expert opinions
relating to the theoretical concept to the next be seen in field applications. How to use the
data collection of primary data and secondary data. Data collection tool using the study of
documents and interview guides. Analysis of data in the form of descriptive analysis is to
analyze the data with data collected in the field.
Results showed that, 1) Implementation of code of conduct notary in the city of
Padang is not maximized because there are constraints such as, unsupported by a factor
of financing and office facilities and infrastructure factors are sufficient to support the
performance of the Honorary Board Regions, so that Padang City Council of Honor have
not been able to perform their duties optimally. 2) The enforcement of codes of conduct
notary by the Honorary Board of Padang about optimizing the tasks and functions due to
lack of awareness of notary public in understanding the rules that exist in the code of
ethics and lack of sharpness board notary association in following up an offense
committed by a notary public so poorly functioning Regional Council of Honor
effectively in overseeing performance notary. 3) The Board of Honor as a party that can
impose sanctions in accordance with the rules contained in oganisasi notary profession,
have difficulty in imposing sanctions because almost all notarial ethics code violations,
such violations are already considered as a habit, and the sanctions imposed by the
Honorary Board of Padang City does not have a result that makes the notary profession
lost, because the heaviest sanctions can be imposed by the Board of Honorary
membership is the dismissal of the Indonesian Notaries Association, so the sanction is
less create a deterrent effect to the notary.
