53/Pdt.G/2008/PN of Bantul aims to find out the effect of authentic certificate in the
practice and find out, understanding and analyzing practice of case resolving
concerning authentic certificate.
The observation research to authentic certification by notary and certificate
making officer (PPAT) in decision of registration number 53/Pdt.G/2008/PN of
Bantul is a empirical juridical approach research. This research focuses on data
research or literature material in secondary data, whether secondary data in form of
primary law material as civil code and civil procedural law, UUJN, Laws concerning
obligation right , PP concerning of Government Regulation concerning Official
Regulation of PPAT, secondary law material as literature relating thesis writing and
the research finding. This research also supported by field research which is primary
data. The various data obtained, and then processed in analytical descriptive report.
Research result (1) the effect in authentic certificate is huge for process
resolving lwasuit which the authentic certificate truthfulness become the judge
consideration to determine lawsuit. (2) Resolving lawsuit concerning authentic
certificate that having problems in Reg. Number 53/Pdt.G/2008/PN Bantul decision
there is an unauthenticated certificate which authorization become the basis of
making those authentic data law defect, thus causing authentic data invalid law after
there is decision of court which having force of definite law. |
