Summary: | This research was aimed at identifying the realization and position of
the good faith principle in the objective (equity) sense in land sale and purchase
binding agreement and deed of power attorney to sell land based on the case study
of the Decision of Sleman District Court, Case Register Number
01/Pdt.G/2010/PN.SLMN. in addition, it is identify legal action that may be
performed when the equity violation harming other parties occurs.
The research was conducted by doing field research, that was collecting
data using interview method which applied interview guide in the form of
question list regarding the subject matter and continued with library research by
studying documents. Data obtained from the research were analyzed qualitatively,
presented descriptively and explained comprehensively.
The result indicates that there are some standards in perceiving the
realization of equity in the land sale and purchase binding agreement and the deed
of power attorney to sell land, namely the deed itself, habits and professional
ethics of notary. The equity itself has important position and role in the
appearance of the land sale and purchase binding agreement and the deed of
power attorney to sell land. Violation of equity principle is one of the elements of
act against the law. The loss as a result of the act violating the equity can be
anticipated through the mechanism of claim for damage based on the act against
the law.
