Summary: | This study aims to determine and assess the role of the notary deed maker
cooperatives and to know the constraints that occur in the founding deed to obtain
legal status of cooperatives.
This study uses empirical juridical approach used to solve the object of
research by examining secondary data on the primary data in the field so as to
answer the problems that could eventually draw a conclusion. Specifications of
this research is analytical descriptive research. This study analyzed the
descriptions, which is analyzed and systematically presents the facts so that it can
be easier to be understood and summed.
Based on this research, through discussion and analysis can be concluded
that the role of the notary in the city of Samarinda it as a public official who has
the principal task of making an authentic deed, as proof he had done a certain
legal act in the establishment, amendment and other deeds relating cooperative
activities for the endorsement applied to the authorities. And the constraints faced
by Notary Public in the process of getting the cooperative corporation, in the city
of Samarinda is a place for this is the draft Deed of cooperatives still have a lot of
shortcomings, especially regarding the rules of equity and the balance of the
Cooperative. Another constraint is as long as there is no standard provisions
governing the rate of cooperative good deed issued by the Office of Cooperatives
and the Notary itself.
