| Summary: | The objective of this research is to investigate the legal position between
CV Mardhotillah Group and Paguyuban Pengusaha Kaveling Mardhotillah RT 09
RW 03 in Secang, Magelang, and the juridical implications of the Authentic Act
Number: 3. On March 18th, 2004 under the sign of notary in Magelang, Normalia
Satiri, SH. to the loans of CV Mardhotillah Group.
Analysis of the study was descriptive with the type of research used was
juridical normative, where the research was conducted with two approachments,
these were literature analysis to get secondary data and field research to get
primary data. Data collected with literature study and conduct interview.
Afterwards, data was qualitative analyzed.
The results showed that (1) the legal position of CV Mardhotillah Group
was clear and firm because it was established based on the authentic act Number:
3. On March 18th, 2004 under the sign of notary in Magelang, Normalia Satiri,
SH., Therefore, the act was bringing the juridical implication to responsibility of
the business risk. While, based on the mere statement by the Parties that is not
included the agreement of fulfilled duty and or the juridical implication to
responsibility of the business risk was becoming not clear. (2) Juridical
Implications of the authentic act Number: 3. On March 18th , 2004 under the sign
of notary in Magelang, Normalia Satiri, SH., obliged to the structure and
commandeer of CV Mardhotillah Group to responsible together for paying the
loans, thereby it was violated against the provision Article 21 and 21 of
Commercial Constitution (KUH)
