| Summary: | This research aims to find out whether the forms and the clauses in the
making of a working contract in the form of Kerosene Concession Agreement
Letter Number : 684/E26000/2002-S3 between PERTAMINA and Kerosene
Agent PT. Kapuas Melawi Indah Sintang District has fulfilled the elements of
good agreement and can represent the interests of the parties before the law, and
also to find out how is the role of Notary in making changes a working contract in
the form of Kerosene Concession Agreement Letter is to be an agreement that can
represent the interests of the parties before the law.
This research was a juridical normative, and also was a juridical empiric.
Field research was used to obtain the primary data, while to obtain the secondary
data was used library research. The sampling technique used was non-random
sampling, which is not every population has a chance to be sampled. Type of
sample used was purposive sampling.
The conclusion of this research are the Kerosene Concession Agreement
Letter Number : 684/E26000/2002-S3 between PERTAMINA and Kerosene
Agent PT. Kapuas Melawi Indah Sintang District has fulfilled the elements of
good agreement, have been able to cover all the will of the parties, made in the
form of under-hand deed so the function of this Kerosene Concession Agreement
Letter is only to prove an event, but do not have the power of the perfect law if it
is not recognized. To solve it this Agreement Letter can re-make and then get
legalized, get registered or made in the authentic deed by and or between the
Notary.
