| description | This research aims to determine the impact of the implementation of the
principle of equal treatment to all investors in the mining sector of the oil in Blora
regency of Central Java. Knowing what are the sectors that influence the
changes in laws and regulations on investment in oil mining sector in Indonesia.
This research uses a normative juridical approach. Normative juridical
approach is used in order to discuss about the object studied in the form of
legislation, expert opinions, case law, and a variety of legal materials relating to
the impact of the implementation of the principle of equal treatment to all
investors in the mining sector. To complement the normative data, it is also used
to generate empirical field data.
These research indicate that the impact caused by the application of the
principle of equal treatment to all investors in the oil mining sector in Central Java
Blora district, which are: the shift amount Domestic Investors (DCI), the difference
in the amount of oil production, the number of concession / field more strategic oil
controlled by foreign investors as well as dependence on foreign oil production.
The results of this research showed that factors affecting the changes in
laws and regulations on investment in the oil mining sector in Indonesia, which
are: the consequences of ratification of the WTO and TRIMs agreements that
Indonesia must adjust any resulting legislation in the field of investment that is
consistent with TRIMs provisions, so that the consequences of this Act come a
Capital Investment the whole contents in accordance with the provisions of
TRIMs agreement. Then filosifis factors as well as ideological and social factors
and imaging (Image) in international relations.
It is expected the government should place a priority direction of
development to the national interest. 1945 Constitution clearly states the earth,
water and natural resources contained therein is controlled by the state and used
for the greatest welfare of the people in the community economic-based
economic system, as well as judicial attempts (judicial review) the provisions of
Article 3 of the Investment Law to Court to repeal provisions of the constitution
contained in the law. |
