description | In Selangor, provisions on dissolutions of marriage can be found in the Islamic Family Law (Selangor) Enactment 2003. Divorce cases are settled by the Syariah Court with competent jurisdictions. The issues pertaining to divorce have not much to do with the laws that govern it, but more on the issues of its settlement in Syariah Court. The public view the issue of delay of divorce settlement as a serious problem in our Syariah judicial system. When there is such delay, the women will be the main ones to suffer the consequences. As a result, came all these allegations that the Syariah Court is gender-biased and discriminating the women. Thus the research analyzes this issue to see whether it is a serious problem in the Syariah judicial system and what are the real factors that caused this problem. The research also seeks to highlight the measures taken by the Syariah Court to overcome this problem and find out to what extent the Court has succeeded in its attempt. The research has identified the contributing factors of delay of divorce settlement from a few different angles and clarified the current scenario of divorce settlement issue in the Syariah Court. The research also incorporated the improvements and achievements to this date. |
