Summary:The first part explains the economic reasons for bankruptcy. The second part draws on the experience of transition countries in general to the field of insolvency. The third part focuses on Croatia. In addition to discussions on the legal aspects, which provide legal and procedural framework, the emphasis is placed on the role of the state and its participation in the bankruptcy proceedings. Attention is paid to the need for harmonization of bankruptcy legislation. Last but not least, the desire of the authors in the conclusion were summarizing the main ideas and to make recommendations for the improvement of bankruptcy in Croatia.
