| description | <p>O artigo aborda a viabilidade da declaração de inconstitucionalidade de lei por ato da Administração Pública, à luz da vertente neoconstitucionalista. Com esse intuito, principia por tratar o princípio da legalidade, identificando o seu ocaso e paulatina substituição pelo conceito de juridicidade. Discorre sobre os limites da competência da Administração para declarar a inconstitucionalidade de lei, a qual não possui a mesma extensão que a do Judiciário. Analisa ainda a natureza jurídica da eficiência, relacionando seu viés econômico ao ideal de justiça, a fim de erigi-la a fundamento necessário do processo de motivação racional da decisão administrativa que conclui pela inconstitucionalidade de lei, o que contribui para o resgate do ideal de justiça inerente ao Direito.</p><p>PALAVRAS-CHAVE: Declaração de Inconstitucionalidade. Justiça. </p><p>ABSTRACT: The article discusses the viability of declaration of unconstitutionality of law by act of public administration, under a neoconstitucionalist approach. It begins by treating the principle of legality, identifying its decay and gradually replacement by the concept of juridicity. It discusses about the competence of Public Administration to declare unconstitutionality of law, which does not have the same extent as in Judiciary. It also examines the legal nature of efficiency, linking its economic bias to the ideal of justice, in order to erect it the necessary foundation of the process of rational motivation of the decision which sets the unconstitutionality of the law, what contributes to the rescue of the ideal of justice inherent to Law. <br /><br />KEYWORDS: Declaration of Unconstitutionality.
